If failing to submit a claim to arbitration and instead files suit, Her Wanderful View, shall be entitled to record its attorney's fees and other costs incurred in the encouragement of the terms of this agreement, including costs incurred seeking a referral to arbitration. Her Wanderful View and users/customers agree that neither party shall be entitled to join or consolidate claims or arbitrate any claim as a representative or class action.
